The protection of names as trademarks within the OEPM is granted without considering that there may exist certain denominations (company names) already registered in the Companies Register, which in most cases caused that the name of a company could be acquired as a trademark by a particular or a company and that the owner of both registrations were not the same.
Recently, this lack of coordination of registrations between these organizations has been amended and there are several business names that the Companies Register turns down, due to the fact that before granting it, a search is performed to ensure that such name – or another very similar – is not already registered and protected as a trademark in the OEPM.
